Minister of Mining Ken Zikhale Ng’oma is demanding K1.5 billion compensation for defamation from Blantyre City South East Constituency Sameer Suleman.
Through his lawyers Taulo and Associates, Zikhale Ng’oma is further demanding that Suleman should cease and desist making all defamatory statements.
“Our Client is educated, respected politician and Member of Parliament as well as a prominent business man. He is also a Minister responsible far Mining in the Republic of Malawi. He has spent years serving the community in his political career and building a positive reputation. Our Client has learned that you have engaged in spreading false, destructive. and defamatory rumors of him. Thus your action has negatively affected our Client’s reputation, work as well as his business.
“Under section 200 of Penal code Cap 7:01 of Laws of Malawi it is unlawful to engage in defamation of another’s character and reputation. Under common law a Defamation consists (1) a statement that tends to injure reputation. (II) communication to another. (III) that the speaker knew or should have known was false.
“Your defamatory statements involved making false claims between month of December. 2024 and January, 2024 through various social media platforms, “that our Client had hired thugs to kill.” It is our Client’s story that he has has never hired anyone to attack you or anyone else and as senior Citizen he respects right to life of every citizens in Malawi including you.
“Accordingly, we demand that you (a) immediately cease and desist your unlawful defamation of our Client and further we demand you to make a public apology of your defamatory statement against our Client within 24 hours in all social media platform that you have been using to damage our Client’s character and reputation.
“We are under strict and specific legal instructions to claim sum of 1.5 Billion from yourselves as compensation for serious damage occasioned as a result of your reckless and misguided defamatory statements. Kindly be advised that we are under legal instructions to seek available legal remedies including seeking injunctive relief and monetary damages of sum of 1.5 Billion if you fail to comply with our demand within 24 hours,” reads part of the demand letter
