The High Court in Mzuzu has nullified the Malawi Congress Party (MCP) primary elections for Mzimba Central Constituency following a legal challenge by Trade Minister Vitumbiko Mumba.
Delivering his ruling on Tuesday, Justice Justus Kishindo found that the process leading to the declaration of Adamson Mkandawire as winner was marred by irregularities that undermined the credibility of the elections.
Mumba, who contested the outcome of the primaries, argued that the electoral college was manipulated and that procedures laid out in the MCP constitution were not followed.
The court has since directed the party to organise fresh primary elections in accordance with its constitution and electoral guidelines.
Lawyer Khumbo Soko, who represented Mumba, welcomed the ruling as a step towards restoring internal democracy within political parties.
Mkandawire and his legal team are yet to comment on the courts decision.
The ruling is expected to set a precedent for how intra-party electoral disputes are handled ahead of the 2025 general elections.
