The court let us down – father speaks on ruling over his son’s death

Adam James, a father to the late Hassan Chimasula who died after being hit by the 18 year-old Abdul Raman Javeed has expressed displeasure with the court ruling on the case.

Last month, Police in Blantyre arrested 18-Javeed for careless driving and charged him with causing death by reckless or negligence.

He was immediately released on Police bail.

Limbe Police spokesperson Aubrey Singanyama said Chimasula died in the evening the same day while receiving treatment at Queen Elizabeth Central Hospital (QECH).

After pleading guilty, the Midima first grade magistrate Lameck Mkwapatula ordered Abdul Raman Javeed to pay a fine of K300,000 and or in default serve a 14 year jail sentence for causing death due to reckless driving.

According to Magistrate Mkwapatula, Javeed was spared the maximum fine of K500.000 cash because he is the first offender.

He ordered that out of the K300 000 fine which was paid, K200.000 should go to the deceased family while K100.000 should be used to meet cost incurred by the court.

Reacting to the ruling, James said as a family, they feel like justice has not been served.

“Here is someone who was playing with his parents vehicle by racing, in the process, he hits an innocent pedestrian who later died. I don’t think we have any road for car racing in Limbe, let along when pedestrians are still using such roads. We can’t believe that the court concluded that such a fine was appropriate.

“As a family we have considered the judgement and we feel justice has not been served. Wa want to seek an opinion of a higher court,” he said
