The case in which the State made an application before the Senior Resident Magistrate Court sitting in Lilongwe to have bail of human rights activist Silvester Namiwa revoked has failed to start.
The case is before Magistrate Wanangwa Nyirenda.
According to Court authorities, the case failed to start because the Magistrate assigned to it did not show up on Friday morning.
They are currently discussing the way forward.
Namiwa is on court bail for an offence of staging illegal demonstrations last year.
Among the bail conditions, Namiwa was ordered not to organise or participate in any demonstrations in the country until the matter is concluded in the Magistrate court which is hearing the case.
However on Thursday October 27, the State argues Namiwa defied the court order as he took part in Anti-Government demonstrations organised by vocal social media activist Joshua Chisa Mbele.
In a notice of hearing of bail revocation hearing which this publication has seen, Namiwa has been summoned to appear before the Lilongwe Senior Resident Magistrate Court on Friday October 28.
The affidavit has been sworn by Police Suprentendant Oscar Nkhoma.
Namiwa was granted bail on August 13, 2021 by the Mkukula Magistrate Court in Lilongwe.
He alongside 10 other members of the CDEDI were charged with holding vigil against written refusal by Lilongwe City Council. They pleaded not guilty.
Appearing at the court today, Namiwa was accompanied by other human rights activists who showed solidarity.
