The Malawi Law Society (MLS) has suspended private practing lawyer Gift Nankhuni from practising the profession of the Law.
According to a notice dated January 29 2025 and signed by MLS honorary secretary Gabriel Gift Chembezi, Nankhuni has been found guilty of fraudulent or improper conduct in the discharge of professional duty and engaging in misconduct bringing the profession of the law into disrepute contrary to sections 89 (2) (b) and 89 (2) (j) of the Act respectively.
He has been suspended for 6 months from 10th January 2025 to 10th July 2025 under section 96(1) (b) of the Act.
He has further been ordered to remit K477,895,833.33 to the complainants and pay K500,000.00 to the Society being costs of the disciplinary proceedings under section 96(2)(a) of the Act.
“Take notice that under Section 99 of the Act, the Society is mandated to publish in the Gazette and in at least two (2) newspapers with the widest circulation, names of Legal Practitioners who have been struck off the Roll or have been suspended and, in the case of suspension, the period of suspension.
“Take further notice that under Section 98 of the Act, a suspended Legal Practitioner is not entitled to practice the profession of the law in Malawi during the period of suspension.
“Members of the General Public are further informed that under section 44(1) of the Act, a Legal Practitioner who has been suspended or disbarred is obliged to make arrangements to hand over all documents and property, including sums of money, of his clients to the clients or another Legal Practitioner.
“Clients of the above Legal Practitioner are advised to immediately follow up on their files with the concerned Legal Practitioner and report to the Society if they encounter any challenges,” reads part of the notice
