Chief Resident Magistrate Madalitso Khoswe Chimwaza has dismissed an application by Prophet Shepherd Bushiri and his wife, Mary.
The two are being wanted to answer various money related charges in South Africa.
In the case the state wants to commence extradition process for the two after the South African government had applied to the Malawi government to have the two extradited to the Rainbow nation
However, through their lawyer, the Bushiris wanted the whole process to be declared a nullity arguing that the documents used by the South African government to commence the process were unauthenticated.
In his ruling, Magistrate Chimwaza said the application was premature.
Following the ruling, Senior State Advocate Dzikondianthu Malunda prayed for progress on the issue, saying there have been many disruptions.
“We hope there will be no further disruptions and that the matter will be determined on the merits,” he told the media.
The case has been adjourned to next month, October 10 when South African witnesses will testify.
The matter will be heard again on October 10, 2023 when the witness from South Africa will testify.
Bushiri and his wife Mary fled South Africa in 2020 where they are accused of money laundering and fraud.
