Vice President Saulos Chilima has applied to the High Court Financial Crimes Division to review the ability of the Anti-Corruption Bureau (ACB) to prosecute him.
Through one of his lawyers, Khumbo Soko, Chilima argues that ACB can not prosecute a case involving the very same contracts it approved.
He is being accused of corruptly receiving US$280, 000 from businessman Zunneth Sattar and US$19 million for assisting Sattar’s company to get a contract from Malawi Defense Force and Malawi Police Service.
Ironically, Reyneck Matemba who was the ACB Director at the time when the contracts were authorised, was arrested in August last year on allegations that he corruptly received USD10,000 as an advantage for the vetting process of the food rations contract from Sattar, Managing Director of Xaviar Limited.
The High Court Financial Crimes Division Judge Redson Kapindu has set August 25 when he will rule on Chilima’s application.
On the same day, Chilima is expected to take plea.
