SA fugitive granted bail despite lower court accusing State, defense of ‘match-fixing’

The principal resident magistrate Godfrey Balaka has granted bail to South African fugitive, Willie Steenkamp who arrived in the country last year as an investor using the name Dr. William Bilderberg.

After denying the fugitive bail four times, the chief resident magistrate Chisomo Msokera described the fourth attempt as resembling “match-fixing” in the way the State and defense handled the bail application.

In the recent ruling, Balaka granted bail to Steenkamp on condition that he pays K5 million cash bond, provide three sureties of K1 million non-cash bond each and surrender his travelling documents.

He further ordered the suspect to report to South West Police Region headquarters every Friday.

Before the ruling, the State through chief state advocate Josephine Gwaza notified the court that it has removed the money laundering count from the charge sheet.

Steenkamp lawyer Felix Tambulasi said following the removal of the money laundering count, the remaining three are minor.

The three counts are furnishing false information, illegal entry into Malawi and false declaration of a Malawian passport.

In the lower court, three times, the State objected to the bail application by the fugitive only to approve the same on the fourth time, citing the deletion of the Interpol alert on internet by Venezuela.

The State said Steenkamp, who faces extradition, is no longer a flight risk.

However, Msokera rejected the application while condemning the State and Steenkamp’s lawyers for trying to undermine justice, before he recused himself from the case.

“We must emphasize that public confidence in the authority of the court is undermined where the court is made to rubberstamp illogical decisions that do not reconcile with the law and the facts.

“This is why we refuse to take part in such an exercise. We refuse to be a referee that is blind to the interests of justice,” the magistrate said.

“We cannot help but marvel at how both the applicant and the State have reasoned and concluded that the applicant (Bilderberg) has ceased to be a flight risk.

“Before we conclude, we must express our concern with the way this application has been handled by the bar. We do not think the bar is incompetent.

“We think that the bar is deliberately putting the interests of the applicant ahead of the interests of justice. This is contrary to the counsel’s duty to the court. And it is more worrying when the prosecution decides to participate in such approach to the administration of justice,” read part of the ruling.

Upon arriving in the country with $20 million (about K23.6 billion) as an investor last year, Bilderberg was granted citizenship and a passport number MWA097282 was given to him on September 27, 2022.

A sworn statement by his lawyer Felix Tambulasi shows that Bilderberg (Steenkamp) was welcomed into the country in October last year by government officials through the Office of the President and Cabinet (OPC) to invest in country as a Malawian.

It means Bilderberg (Steenkamp) was granted the citizenship and a local passport before he arrived in the country.

According to a security alert by Mike Bolhuis, Specialized Security Services providers, renowned for Wurban-scam, Bilderberg (Steenkamp) together with his partner Jacobus Johannes Christoffel Du Toit were a financial consultant and the head of an international investment company that promised investors massive returns.

However, the two disappeared with the investments made.

The sworn statement further said government later helped him establish his business, Bilderbert Company and later secure finances for the fugitive to start operating in Malawi.

  • BPI urges entrepreneurs to seek technical assistance

BPI urges entrepreneurs to seek technical assistance

Business Partners International (BPI) Malawi, a fund manager that provides debt equity financing, has encouraged entrepreneurs to seek technical assistance in building their businesses.

BPI Malawi Country Manager, Akuzike Kafwamba made the call during a breakfast interaction with small and medium entrepreneurs (SMEs) in Blantyre over the weekend.

Making his presentation, Kafwamba said technical assistance enhances the business processes in each business invested in, and also helps to mitigate risks associated with increased funding into the business, which might lead to default.

Apart from improving and increasing efficiency in the operations of the business, Kafwamba further said technical assistance adds value to the business in different areas.

“It is appreciated that SMEs do not have the level of sophistication that larger enterprises have, and therefore in addition to core funding, require to have their business processes enhanced in order to create more efficiency and professionalism in their operations.”

“Business Partners provides technical assistance to its investee clients upon approval of the main loan. Each investee client is eligible for up to 30% of the main loan amount, in form of technical assistance during the term of their loan.”

“Identification of technical assistance needs is made during the due diligence period and also during the monitoring period while the term of the funding runs. The technical assistance loans are interest free and subordinated to the main loan with flexible payment terms,” he said.

One of the participants, Chimwemwe Nyirenda of Hashtag Communications commended BPI Malawi for the eye-opening interaction.

Nyirenda said failure by SMEs to consult experts for technical assistance affects the growth of their businesses.

“Through the technical assistance, one is also able to get mentors who can play a big role in growing the business through networking with other potential clients. Through this networking, the mentors may recommend your business to others,” he said.

Some of the issues involved in technical assistance are financial management systems, trainings like sales, customer service, corporate governance, recruitment/human resources, automation of operating processes, business trade fairs, environmental processes, health and safety training, mentorship by industry experts, familiarization tours, ISO certification, marketing strategy and others.

  • Fuel deals case: Chakwera, bidder agreed on health centers construction

Fuel deals case: Chakwera, bidder agreed on health centers construction

The Chief Resident Magistrate Court in Lilongwe heard on Monday that President Lazarus Chakwera met with Finergy officials, a potential fuel supplier, to discuss corporate social responsibility, pending the company’s bid approval.

This information came to light during the cross-examination of former National Oil Company of Malawi (Nocma) Deputy Chief Executive Hellen Buluma in the ongoing fuel import deals trial.

In this case, former Energy minister Newton Kambala, Alliance for Democracy president Enoch Chihana, and former chief Presidential Adviser on Strategy Chris Chaima Banda are accused of trying to influence Buluma to award contracts to Orxy, Finergy, and Trafigura.

When asked by defense lawyer Bright Theu if she knew about the Finergy team meeting with Chakwera, Buluma responded negatively.

Theu then presented transcribed conversations where Banda informed Buluma that he had accompanied the bidder’s team to meet the President, a similar discussion he had with Kambala.

In her response, Buluma expressed doubt about their statements, as it was not uncommon for individuals to claim they were sent by the President.

She also mentioned that the two were collaborating, making it plausible for them to convey the same information.

These conversations were part of the audio recording Buluma submitted in court as evidence, demonstrating that the three were pressuring her to award fuel deals to the company.

Meanwhile, Chief Resident Magistrate Madalitso Chimwaza ordered the Anti-Corruption Bureau (ACB) to make available the Finergy presentation to Chakwera, after one of the defense lawyers Wapona Kita told the court that the graft busting body seized it from Banda.

Hearing of the case continues today.

The accused were apprehended in August 2021.

Tobacco industry holds conference on leaf integrity

A one-day Malawi tobacco industry conference, seeking to discuss data management vis-a-vis tobacco leaf integrity and other issues, is set to he held this Friday in Lilongwe.

To be held at Ufulu Gardens, the 2023 tobacco industry conference will be attended by the Tobacco Commission (TC), tobacco buying companies, grower associations and research institution, ARET, among others.

TC public relations officer Telephorus Chigwenembe said the annual conference takes place when Malawi steps up her efforts to consolidate her position as the producer of the world’s most preferred tobacco, especially the burley type.

“Industry regulator, the Tobacco Commission, is optimistic delegates to the conference will subject data management practices in tobacco to rigorous discussions to ensure improvements that will make Malawi tobacco more compliant with global standards.

“Among others, data management of high standards in tobacco facilitates traceability, which is key in fighting child labour and other social ills associated with the production of the crop,” he said

In 2023, 120 million kilogrammes of tobacco was sold, up from 85 million kilogrammes sold in 2022.

This season, the Tobacco Commission has since licensed more than 248 million kilogrammes of the leaf in a registration and licensing process that goes up to the end of January.

The Tobacco Commission envisions an annual production of 200 million kilogrammes by 2028.
