High Court Judge Kenyatta Nyirenda on Tuesday threw out an application by Secretary to the President and Cabinet (SPC), Justin Saidi to discharge an injunction by five senior Malawi Defence Force (MDF) Generals.
The five, Major Generals Chikunkha Soko, Saiford Kalisha, Swithan Mchungula, Kakhuta Banda, and Brigadier General Harold Dzoole, successfully obtained an injunction from the High Court in Malawi in late 2025, temporarily stopping the government from redeploying them to civilian roles.
They were redeployed to work as directors of security at Electricity Supply Corporation of Malawi, National Oil Company of Malawi, Agricultural Development and Marketing Corporation and Electricity Generation Company, respectively.
The legal action, brought by the officers to challenge their reassignment, effectively stayed the transfers, with the court allowing their legal challenge to proceed against the government’s move.
Justice Nyirenda has said hearing for the judicial review will take place in open court on January 16 2026
